Using your superannuation

The ATO allows part of your superannuation to be released early to pay for serious medical treatment you cannot otherwise afford - this is called compassionate release of super, and dental treatment is one of the conditions it covers. Orthodontic treatment, including Invisalign clear aligners, is among the treatments it can be used for.

Whether your case is likely to qualify

  • The treatment is to relieve acute or chronic pain, acute or chronic mental disturbance, or a life-threatening condition
  • You cannot afford the treatment by other means, including savings, loans or payment plans
  • The treatment is not purely cosmetic - this matters for clear aligners, and it is the question we will answer honestly before you apply rather than after
  • You or a dependant needs the treatment, and you meet the ATO's identity and residency requirements

How the process runs

  1. Consultation and treatment plan

    We assess your case and plan the treatment.

  2. Written quote

    We prepare a detailed quote formatted to the ATO's requirements.

  3. Supporting statements

    Two written reports are needed - one from us, and one from a specialist or GP.

  4. Application lodged

    Applications are handled through SuperCare or AccessMySuper, the Australian services that assemble the paperwork and lodge it with the ATO on your behalf.

  5. ATO decision

    The ATO typically responds within 14 to 28 days.

  6. Funds released, treatment begins

    Your super fund usually releases the approved amount 5 to 10 business days after approval, and we schedule your treatment once funds clear. Most patients go from first consultation to approved funds in about four to six weeks.

  • Proof of identity, your super fund member details, and a bank account for the released funds

Before you apply, understand this

  • Money released on compassionate grounds is generally taxed - the rate depends on your age and the components of your super
  • Money drawn from super now loses decades of compound growth, so it has a real long-term cost to your retirement
  • SuperCare and AccessMySuper charge a service fee for managing the application, which varies by case and provider - ask them for a fee quote before committing
  • You can only release an amount matching the quoted treatment cost; any unused balance goes back into your super
  • Approval is not guaranteed - the ATO can reject applications
